Credit hire after a crash on the Spit or Military Road

If you were hit from behind on the Spit or Military Road and it was not your fault, you can keep driving something comparable while your car is repaired, and the at-fault party's insurer is the one who should end up paying for it. That is credit hire, and on this corridor it is a daily event.

The Spit Road and Military Road funnel is the worst morning pinch in Sydney: three lanes squeezing toward the Spit Bridge, no shoulder, and a red light every few hundred metres. Nose-to-tail crashes are routine. Your replacement needs to reach Mosman, Cremorne, Neutral Bay or Manly, often the same day, and it needs to be the kind of car you were driving.

Key takeaways

  • The Spit Road and Military Road corridor is Sydney's worst morning funnel, and rear-end crashes there are usually clear not-at-fault claims.
  • If you cannot pull over on the Spit, move to the Spit East car park or the BP on Spit Road before exchanging details.
  • A like-for-like replacement is the standard the law supports, and on this corridor that means a prestige or performance car, not a compact.
  • Delivery to Mosman, Cremorne, Neutral Bay and Manly is routine, but timing and handover points matter because of clearways and bus lanes.
  • Buses and trucks are covered by fleet policies, so you deal with the operator's claims process, not the driver.

Why this corridor produces so many rear-end crashes

Drive south on the Spit Road approach at 7.45am on a Tuesday and you will see the problem in one glance. Traffic comes off the bridge, climbs past Spit Junction, and then hits the Military Road run through Mosman, Cremorne and Neutral Bay, where lights, bus stops and right-turn pockets interrupt the flow every few hundred metres.

The result is a stop-start accordion. Drivers brake late, glance at a phone, or misjudge the gap when the car in front hesitates. The road gives you almost no escape route: kerbside parking, bus lanes and narrow footpaths mean there is often nowhere to swerve. When it goes wrong, it goes wrong at low speed but high volume, which is exactly the recipe for a rear-end shunt.

Two other factors matter. First, the corridor carries a lot of trades and deliveries in the early peak, so you have vans and utes with poor rear visibility in the mix. Second, the Spit Bridge itself opens for maritime traffic, which stacks cars for several minutes and then releases them in a rush. That release is when the chain-reaction crashes happen.

If you are the middle car in a three-car shunt, the law still treats you as not at fault for the hit from behind, provided you were not reversing or already stopped illegally. The rear driver owes you a replacement car while yours is off the road. The general principle comes from Arsalan v Rixon, which confirmed that a not-at-fault driver can recover the reasonable cost of a like-for-like replacement. For the full picture, see not at fault explained.

What to do when you cannot pull over on the Spit

The Spit itself, between the bridge and the spit reserve, has no safe shoulder. If you are hit there, do not stop in a live lane to argue. Put your hazard lights on, and if the cars are drivable, move to the first safe place: the Spit East car park near the marina, the boat ramp area, or the BP on the corner of Spit Road and Ourimbah Road. If the cars will not move, stay belted, call 000 if anyone is hurt, and call the police non-emergency line if the road is blocked.

Once you are off the carriageway, do these things in order:

  1. Photograph both cars from several angles, including the number plates and the position of the cars relative to lane markings.
  2. Photograph the other driver's licence, rego sticker or plate, and their insurer if they have it on a phone screen.
  3. Write down the time, the weather, and which lane you were in. Insurers love a clear lane diagram.
  4. Get names and numbers of any independent witnesses, especially a bus driver or a pedestrian on the footpath.
  5. Do not admit fault, even politely. "Sorry" is a habit, not a legal position, but it gets quoted.

If your car is drivable, you can usually drive it home or to a repairer. If it is not, a tow is the next call. The first 24 hours page walks through the order of operations in more detail.

Towing from Military Road at 8am

Military Road at 8am is not a place to wait for a tow truck you found on a random search. The clearway rules, the bus lane and the sheer volume mean a tow operator needs to get in and out fast, and a car sitting in a live lane will be moved by police or Transport for NSW fairly quickly.

What actually works on this road:

  • Tell the tow operator exactly where you are, including the nearest cross street such as Raglan Street, Belmont Road or Wyong Road, and which direction you are facing.
  • Ask for a flatbed if your car is all-wheel drive or has low-profile tyres. Dragging a performance car onto a tilt tray can damage a splitter or a wheel.
  • Confirm where the car is going before it is loaded. If you have a preferred repairer in Artarmon or Brookvale, say so. Once it is on the truck, changing the destination costs time and money.
  • Keep the tow docket. It is part of your claim.

If the crash is minor and both cars are drivable, you can often skip the tow entirely and drive to a repairer or a safe car park. The key is to clear the lane, because the longer you sit there, the more likely a second impact happens.

While the car is being sorted, the replacement question comes up fast. Bookings are fulfilled by Drive Tribe (drivetribe.com.au), the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group. Exchanging details in traffic

Exchanging details on a live road is a negotiation with traffic. Do it quickly, do it safely, and do not turn it into a debate about who was at fault.

The minimum you need from the other driver:

  • Full name, address and phone number.
  • Licence number and state.
  • Registration number, make, model and colour.
  • Their insurer and policy number if they have it.

What you should give them: the same, plus your insurer if you are willing. You are not obliged to hand over your insurer's details at the roadside, but it usually speeds things up.

If the other driver is aggressive, refuses to exchange details, or appears affected by drugs or alcohol, step back, note the plate, and call police. Do not chase the argument. A rear-end crash on Military Road is usually clear-cut, and the physical evidence plus any witness will do the work.

If the other driver is in a company car or a rideshare, get the company name and the fleet manager's contact if you can. That single detail can save a week of insurer back-and-forth. For more on how the claim is run, see dealing with insurers.

Delivery to Mosman, Cremorne, Neutral Bay and Manly

The whole point of a replacement car is that it turns up where you are, not at an airport counter. On the lower north shore and the beaches, delivery is usually straightforward because the postcodes are dense and the streets are known.

Practical notes for each area:

  • Mosman: Military Road and Spit Road have clearways and bus lanes, so a delivery driver will often meet you in a side street such as Vista Street or Muston Street, or in the car park at Mosman Square.
  • Cremorne: the streets around Cremorne Junction are tight. A side street off Military Road, or the Coles car park on Rangers Road, works better than the main road.
  • Neutral Bay: the Woolworths car park on Bent Street or a side street off Military Road is the usual handover point.
  • Manly: the Whistler Street car park, the Manly Oval area, or a driveway in Fairlight or Balgowlah if you are further along.

Timing matters. A morning handover before 7.30am avoids the worst of the traffic. If you need the car at your home or office, say so when you book, because the delivery window is built around the driver's run, not the other way around.

For a prestige or performance car, insist on a like-for-like replacement rather than a generic compact. That is the standard the law supports. See like for like for what that means in practice.

If the crash blocks the bridge approach

A crash on the Spit Bridge approach is a different problem. The bridge is a pinch point, and when a lane is blocked on the northern or southern approach, the queue backs up fast, sometimes all the way to Spit Junction or down to the Wakehurst Parkway turnoff.

If you are in a crash that blocks the bridge approach:

  1. If the cars can move, move them. The bridge is not a place to leave a vehicle if it is drivable.
  2. If they cannot move, call 000 if anyone is injured and ask for police attendance. A blocked bridge approach is a traffic hazard and will be cleared quickly.
  3. Take your photos and details as soon as it is safe, even if you are standing on the footpath or the median.
  4. Expect a longer wait for a tow, because the operator has to get through the same queue you are in.

Once the road is clear, the insurance side is the same as any other not-at-fault claim. The delay is in the traffic, not the paperwork.

If your car is towed and you are stuck without transport, a replacement can usually be arranged the same day or the next morning, subject to availability. The how credit hire works page explains who pays and how the claim is built.

Dealing with a bus or a truck in the same crash

If a bus or a truck is involved, the claim changes shape. Buses and heavy vehicles are usually covered by a fleet policy, and the operator's insurer or claims manager handles it, not the driver. That can be good news, because fleet insurers are used to these claims, but it also means you are dealing with a process rather than a person.

What to do:

  • Get the bus or truck's fleet number, depot or operator name, and the driver's name and licence details if they will give them.
  • Ask for the operator's claims contact. If the driver cannot provide it, the operator's website or depot will.
  • Note the route number and the time, because bus operators can pull GPS and camera footage.
  • If there are passengers on the bus, expect them to be listed as witnesses. That usually helps you.

Do not assume the bus company will handle everything for you. They handle their own driver's liability, but your replacement car and your repairs are still your claim to run. Keep your own records and your own correspondence.

If the at-fault insurer disputes the hire, the process is set out at when an insurer disputes a credit hire claim.

Following up when the insurer is slow

Insurers are not slow on purpose, but they are slow when the file is incomplete. The fastest way to move a not-at-fault claim is to give the insurer everything in one go and then follow up on a schedule.

A workable follow-up routine:

  1. Lodge your claim and get a claim number the same day if possible.
  2. Send photos, the other driver's details, the police report number if there is one, and the tow docket in a single email.
  3. Ask for the name of the assessor and a direct contact. If you only have a call centre number, ask for the assessor's email.
  4. Follow up every three business days. Keep it short and factual: what you sent, when, and what you are waiting for.
  5. If the repair is delayed, ask whether the delay is parts, workshop capacity or authorisation. Each has a different fix.

For prestige and performance cars, parts delays are common. A bumper or a headlight for a European car can take weeks, and that is when a like-for-like replacement matters most. See how long prestige car repairs take in Sydney.

If the insurer is slow to respond on the hire itself, the credit hire provider usually carries the cost in the meantime and recovers it later. That is the point of the arrangement. For the detail, see how the at-fault insurer pays for hire.

What happens next, and who to call

Once the crash is cleared and the details are exchanged, the practical question is how you get to work tomorrow. On this corridor, that usually means a replacement car delivered to a driveway, an office car park or a side street near the repairer.

The steps are simple:

  • Confirm you are not at fault and get the other driver's details.
  • Choose a repairer, or let your insurer nominate one.
  • Arrange a like-for-like replacement for the duration of the repair.
  • Keep the paperwork together: claim number, tow docket, hire agreement, and any correspondence.

If you drive something worth replacing properly, a compact hatch is not a like-for-like substitute. A prestige SUV or a performance sedan is the standard the law supports, and the at-fault insurer is the one who should end up paying for it. The rate, the bond and any fees are shown on the car's page before you pay, so there are no surprises.

If you are a fleet manager, a smash repairer or a solicitor looking for a referral partner, the partners and referrals page explains how that works. For the full Sydney accident replacement service, see drivetribe.com.au/accident-replacement-car-sydney.

Questions people ask

Can a replacement car be delivered to Manly the same day?
Often yes, subject to availability. If the crash happens in the morning and the paperwork is in order, a car can usually be delivered to Manly, Fairlight or Balgowlah the same day or the next morning. The handover is typically at a car park such as Whistler Street or a side street off Sydney Road. It helps to have the other driver's details, your claim number and a clear idea of where the car will be repaired before you book.
What if I cannot safely stop on the Spit?
Do not stop in a live lane. Put your hazard lights on and, if the cars are drivable, move to the first safe place, such as the Spit East car park near the marina or the BP on the corner of Spit Road and Ourimbah Road. If the cars cannot move, stay belted, call 000 if anyone is hurt, and call police if the road is blocked. Take photos and exchange details once you are off the carriageway.
Does a bus company handle its own claims?
Yes, bus and truck operators usually have fleet policies and a claims team, so you deal with the operator's insurer or claims manager rather than the driver. Get the fleet number, route, depot and the driver's details, and ask for the claims contact. The operator handles its own driver's liability, but your replacement car and repairs are still your claim to run, so keep your own records.
Who pays for the replacement car after a not-at-fault crash?
In a credit hire arrangement, the at-fault party's insurer is the one who should end up paying for your replacement car while yours is repaired. You do not pay upfront. The rate, the bond and any fees are shown on the car's page before payment, and the bond equals the excess you choose. If the insurer disputes the hire, the provider usually carries the cost in the meantime and recovers it later.
What is a like-for-like replacement car?
Like-for-like means a replacement that is broadly comparable to the car you were driving, in size, type and standard. If you drive a prestige SUV or a performance sedan, a compact hatch is not a like-for-like substitute. The principle was confirmed in Arsalan v Rixon, which supports recovering the reasonable cost of a comparable replacement while your car is off the road.
How long can I keep the replacement car?
You can usually keep it for the reasonable duration of the repair, plus a short period for collection and delivery. If parts delays stretch the repair, the hire period stretches with it, provided the delay is reasonable and documented. Keep the hire agreement and any correspondence with the repairer and insurer together, because the hire period is one of the things an insurer will look at if the claim is reviewed.
