If you have been hit on Bondi Road or clipped on Oxford Street and it was not your fault, you are entitled to stay in a car of similar standard to your own while yours is repaired. In the Eastern Suburbs that usually means a replacement delivered to your door, not a bus to Mascot.

The tight streets, the parked cars and the visitors who do not know New South Head Road all make this postcode one of the busiest for not at fault claims in Sydney. This guide covers who pays, how long it takes, what to do about your parking permit, and what happens when the other driver is a tourist or a rideshare.

Key takeaways

  • If the other driver is at fault, you can stay in a car of similar standard to your own for the whole repair, including parts delays.
  • Delivery to Bondi, Paddington, Double Bay and Woollahra is normal, but think about parking permits and narrow streets before the car arrives.
  • Overseas drivers and rideshare vehicles slow the claim down, not your entitlement; get police and platform references early.
  • A cash settlement offer should never be accepted on the day it arrives; get an independent prestige repair quote first.
  • You choose your repairer in NSW, and the replacement car should stay with you until the repair is genuinely finished.

The crash hotspots: Bondi Road, Oxford Street, New South Head Road

You do not need statistics to know where the Eastern Suburbs crashes happen. Spend a Saturday on Bondi Road and you will see them. The 40 km/h strip between Bondi Junction and the beach squeezes two lanes of traffic past parked cars, delivery vans and pedestrians stepping out between them. Rear-end shunts at the Bondi Road and Denham Street lights are the classic. So are mirror strikes where a driver drifts wide to avoid a cyclist.

Oxford Street through Paddington and Woollahra is worse for side impacts. The kerbside lanes are parking lanes for most of the day, so a car pulling out of a space at 5pm on a Friday has almost no sight line. T-bones at the Jersey Road and Queen Street intersections are common, and so are scrapes along the parked row outside the pubs.

New South Head Road is the fast one, and that is the problem. Traffic runs 60 km/h from Edgecliff through Double Bay and Rose Bay, with bus stops, driveways and a median that hides oncoming cars at the gaps. Right-turn crashes at the Ocean Avenue and Bay Street lights are frequent, and tourist drivers who have just come off the ferry at Rose Bay often misjudge the merge.

Two things matter after any of these. Get the other driver's details and a photo of their licence and rego, and get a photo of the position of both cars before anything moves. If the other driver admits fault at the scene, that is useful, but it is not the end of the story, because insurers decide fault, not drivers. Our guide to what not at fault means in NSW explains how that decision is actually made.

Parked car scrapes and who is at fault

Half the calls we see from Bondi and Paddington are not crashes at all. They are parked car scrapes. You come back to your car on Curlewis Street or Glenayr Avenue and there is a scuff along the rear quarter, or a mirror hanging by its wires.

Fault here is usually simple. If someone hit your parked car, they are at fault, whether they left a note or not. If you hit a parked car, you are at fault, even if you only nudged it. The hard cases are the ones where nobody saw it happen and there is no note.

What to do:

  • Photograph the damage close up and from two metres back, showing the whole panel and the surrounding street.
  • Look for paint transfer. If the other car was white and yours is dark, the colour tells a story.
  • Check for a note under the wiper and photograph it before you touch it.
  • Ask nearby shops for camera footage the same day. Bondi and Double Bay retailers overwrite footage quickly, often within 48 hours.
  • Report it to police if the damage is significant or the driver left without leaving details. You need a police event number for the insurer.

If the other driver is identified and their insurer accepts fault, you can claim a replacement car even though your own car was parked and empty. If nobody is identified, you are usually claiming on your own policy, and whether you get a hire car depends on your cover. That is a different conversation, and it is worth reading not at fault explained before you ring anyone.

Local prestige repairers and their wait times

The Eastern Suburbs has a small number of workshops that are genuinely set up for prestige and performance cars, and they are busy. A BMW or Porsche approved repairer in Alexandria or Botany might be booking three to five weeks out for a non-driveable job, longer in the weeks before Christmas and in the first month of the year.

Wait times are not just about the workshop. They are about the insurer's assessment queue, the parts, and whether the repairer needs the car stripped before the quote can be finalised. A panel shop in Woollahra or Rose Bay can do a beautiful job and still hold your car for six weeks because a headlight is on a ship.

What you can control:

  1. Choose your own repairer. In NSW you are not obliged to use the insurer's preferred shop. Our page on prestige repairer versus insurer preferred repairer sets out the trade-offs.
  2. Ask for a written estimate of the start date, not just the finish date.
  3. Ask whether the car will be stored inside while it waits. Salt air and Bondi seagulls do not improve paint.
  4. Keep the replacement car for the whole repair period, not just the first fortnight.

If your car is driveable, get two quotes before you commit, and photograph everything before it goes in. If it is not driveable, the tow goes to the repairer of your choice, and the replacement car should be arranged the same day. Bookings for replacement vehicles are handled through accident replacement cars in Sydney, where you can see what is available before you commit.

Not at fault? Start your claim

A like-for-like replacement car while yours is repaired. No cost to you when the other driver is at fault.

Start my claim

Delivery of a replacement car to Bondi, Paddington or Double Bay

Nobody in a not at fault claim should be catching two buses to collect a hire car. Delivery is standard, and in the Eastern Suburbs it is straightforward if you think about parking before the driver arrives.

Where the car can be dropped:

  • Bondi: Hall Street, Curlewis Street or the quieter end of Campbell Parade, outside the morning swim and the evening dinner rush.
  • Paddington: Oxford Street is a no, but Glenmore Road, Brown Street or the back of Five Ways works.
  • Double Bay: Cross Street or the Knox Street car park entrance, avoiding the 7am to 9am school run.
  • Woollahra: Queen Street or Ocean Street, mid-morning.

Have your licence, a card in your name and your claim reference ready. The handover takes about fifteen minutes: walk around, photograph the existing condition, note the fuel or charge level, and check the toll tag situation. If you have an e-tag in your own car, ask how tolls are handled on the replacement.

Timing matters. If you are booking a car for a Bondi to CBD commute, an electric sedan is the sensible pick, and a Taycan is the obvious like-for-like if your own car is in that class.

If the other driver is a visitor or rideshare

Two scenarios come up constantly in Bondi and Double Bay. The other driver is a visitor from overseas, or the other driver is working for a rideshare platform.

Overseas driver. They may hold a foreign licence, they may be in a rental car, and their insurer may be based overseas. None of that changes your position if they were at fault. What changes is the pace. You will deal with their rental company's claims team, or an overseas insurer, and that can add weeks. Get their passport or licence details, the rental agreement if you can see it, and the rental company's name. Then let your replacement car provider and, if needed, your solicitor chase it. You are not obliged to wait for a foreign insurer to admit fault before you are back in a car.

Rideshare. The driver is covered by the platform's insurance while they are on a trip, and by their own policy when they are not. That distinction matters, and it is often argued. Take a screenshot of the trip in the app if you were a passenger, and get the driver's details and the platform's incident reference. Do not accept a cash offer at the roadside from a rideshare driver. It rarely ends well.

In both cases, the practical steps are the same: report to police, get an event number, notify your insurer, and get yourself into a replacement car. The first 24 hours page walks through the order of operations.

How long repairs take when parts come from overseas

This is where Eastern Suburbs claims go wrong. The repair itself might be ten days. The parts might take ten weeks.

European prestige cars are the worst affected. A bumper cover, a radar module, a headlight or a specific alloy can be backordered from Germany or the UK, and the car sits at the shop in the meantime. Some modules need coding to the car, which only a franchised dealer or an approved independent can do, and that adds another appointment to the queue.

What to expect:

Part typeTypical extra wait
Common service partsDays
Body panels and bumpersTwo to six weeks
Headlights, sensors, modulesFour to twelve weeks
Special order trim or wheelsEight weeks and up

Those are general ranges, not promises, and your repairer will give you the real number once the car is stripped. The key point is that a parts delay is not your problem to absorb. If the repair is genuinely delayed and the other side is at fault, the replacement car should stay with you for the duration. Our pages on how long prestige repairs take in Sydney and parts delays in NSW go deeper, and who pays for the hire car during delays answers the question everyone asks.

Keeping your parking permit and street parking in mind

Woollahra and Waverley parking permits are issued against a specific vehicle and registration. When your car goes into the shop and a replacement arrives, your permit does not automatically transfer.

What to do:

  • Contact the council as soon as you know the replacement rego. Woollahra and Waverley both have processes for temporary vehicle changes, and it is easier before a ticket is issued than after.
  • Photograph your permit and your old car's rego before the car leaves for the repairer.
  • If you get a ticket while the paperwork is in progress, keep the replacement car's hire agreement and the repairer's job sheet. You will need both to contest it.
  • Check whether your street has time-limited parking. A large replacement SUV may not fit the same gap your coupe did.

One more local issue: driveways. In Paddington and Bondi, many streets are narrow enough that a replacement car parked slightly differently will block a neighbour's driveway. Be deliberate about where you leave it, especially overnight.

If you are in a strata building with a single allocated space, tell the building manager. It avoids a tow and a very annoying conversation.

What to do if the insurer offers a cash settlement

A cash settlement offer arrives by email, usually with a deadline attached. It is not automatically a bad deal, but it is not automatically a good one either.

Before you accept:

  1. Get an independent repair quote from a prestige specialist. The insurer's figure is based on their assessment, not your repairer's.
  2. Check whether the offer is for repair or for a write-off. They are very different.
  3. If it is a write-off, ask whether it is statutory or repairable, and what happens to the salvage.
  4. Ask what happens to your replacement car if you accept. It usually stops.
  5. Do not sign anything on the day you receive it.

A cash settlement can suit you if the damage is minor and you would rather manage the repair yourself. It rarely suits you if the car needs structural work, if parts are delayed, or if the offer is below what a proper repair costs at a shop you trust.

If the car is written off, the process is different again, and our guides to statutory write-offs in NSW and cash settlement versus repair set out the paths. If you are unsure, talk to your solicitor before you sign.

When you are ready to get back on the road, replacement vehicles are booked through accident replacement vehicles, and the funding options are compared at credit hire versus paying yourself.

The law, in plain English

You do not need to memorise case law, but it helps to know the principle. In NSW, a person who is not at fault in a crash is entitled to be put back in the position they would have been in but for the crash. For a prestige car owner, that means a replacement car of similar standard, not the cheapest thing on the lot.

That principle was tested in Arsalan v Rixon, and the outcome supports like-for-like replacement in the right circumstances. The practical version is this: if your car is a Porsche, you are not expected to spend six weeks in a base hatchback. Our page on like-for-like explains what similar standard means in practice, and how credit hire works explains who fronts the money while the claim is resolved.

Two things to keep in mind. First, the entitlement depends on the other driver being at fault, and that is decided by insurers, not by you. Second, the length of the replacement hire should match the length of the repair, within reason. If the repair is delayed by parts, the hire should extend. Our page on how long you can keep a replacement car covers the boundaries.

Questions people ask

Can I get a replacement car delivered to Bondi?
Yes. Delivery is available across the Eastern Suburbs, including Bondi, Bondi Junction, Paddington, Double Bay and Woollahra. The driver will meet you at a street address you nominate, usually somewhere with a clear parking spot such as Hall Street or the quieter end of Campbell Parade. Have your licence, a card in your name and your claim reference ready. The handover takes about fifteen minutes and includes a condition check and a note of the fuel or charge level.
What if the at-fault driver is from overseas?
Their nationality does not change your entitlement if they were at fault. It does change the pace, because you may be dealing with an overseas insurer or a rental company's claims team. Get their licence or passport details, the rental company name if there is one, and a police event number. You do not have to wait for a foreign insurer to admit fault before you are back in a replacement car. If the claim stalls, talk to your solicitor.
Should I accept a cash settlement?
Not on the day it arrives. Get an independent quote from a prestige repairer first, and check whether the offer is for repair or for a write-off. A cash settlement can work if the damage is minor and you want to manage the repair yourself. It rarely works if there is structural damage, if parts are delayed, or if the offer is below what a shop you trust would charge. If you are unsure, speak to your solicitor before signing.
How long can I keep the replacement car?
For as long as the repair reasonably takes, including any parts delay, provided the other driver is at fault. If your car is written off, the replacement hire usually ends when the claim is settled. Keep the repairer's job sheet and any parts delay notifications, because they justify the length of the hire. If the insurer disputes the duration, our page on repair delays explains who pays.
Do I have to use the insurer's preferred repairer?
No. In NSW you can choose your own repairer. The insurer may prefer one of their network shops, and using it can speed up assessment, but it is your decision. Many prestige owners in the Eastern Suburbs use a specialist in Alexandria, Botany or Rose Bay. Get two quotes, photograph the car before it goes in, and ask for a written start date rather than just a finish date.
What if the other driver was a rideshare car?
The driver is covered by the platform's insurance while on a trip, and by their own policy when off it. That distinction is often argued, so get the driver's details, the platform's incident reference and any trip screenshot. Do not accept a cash offer at the roadside. Report it to police, notify your insurer, and arrange a replacement car. The claim may take longer, but your entitlement does not disappear.
