Tesla replacement car when you are not at fault

Steering wheel of the silver 2025 Tesla Model Y RWD, available for hire in Sydney

If your Tesla is damaged in a crash that was not your fault, you are entitled to a replacement vehicle that puts you back in a comparable car, not a base petrol hatch. In New South Wales, that means a like-for-like Tesla: same model where possible, same performance tier, same electric drivetrain, arranged through credit hire and paid for by the at-fault party's insurer.

This guide covers how a Model 3, Model Y or Model X replacement is arranged in Sydney, how charging works while you have it, what happens at delivery in Merrylands or Parramatta, and what to check before you drive away.

Key takeaways

  • If your Tesla is damaged and you are not at fault, you are entitled to a like-for-like replacement, which means an electric Tesla of comparable model and specification, not a petrol rental.
  • The NSW Court of Appeal decision in Arsalan v Rixon confirms that the replacement does not have to be the cheapest car available, only a reasonable match for what you were driving.
  • Replacement Teslas in Sydney are delivered to your home, workplace or repairer, with Merrylands and Parramatta as the main handover bases.
  • Charging works the same as your own car, including Supercharger access, and charging costs are part of the running costs of the substitute vehicle.
  • Keep a written file of the police event number, photos, repairer estimates and insurer correspondence, because that file is what resolves a disputed hire.

Why a petrol rental is not a like-for-like Tesla replacement

You drive an electric car. A petrol Corolla from a conventional rental desk is not a like-for-like replacement, and you should not accept one just because it is offered. Like-for-like means the replacement should be broadly comparable in make, model, age, condition and specification to the car you have lost the use of. For a Tesla owner, that means an electric vehicle of similar size and performance, not a car that needs a fuel stop on the M4 and has none of the software you rely on.

The legal foundation in New South Wales is the Court of Appeal decision in Arsalan v Rixon [2021] NSWCA 254. The court confirmed that a not-at-fault driver can recover the reasonable cost of hiring a replacement vehicle while their own car is off the road, and that the replacement does not have to be the cheapest available. It has to be reasonable, and reasonableness is measured against what you were driving.

In practice, that means:

  • An electric replacement, so your running costs and driving routine are not disrupted.
  • A comparable body style: Model Y and Model X are SUVs, Model 3 is a sedan.
  • A comparable performance level where your car is a Performance variant.
  • Access to the Tesla charging network, which is part of what you paid for.

If you drove a Model 3 Performance, a base Model 3 is a weaker match than a Performance. If you drove a Model X with seven seats, a five-seat SUV changes your school run and your weekends. Insurers will sometimes push a cheaper substitute; the answer is not to argue at the roadside, but to have the replacement arranged properly through a credit hire provider that documents the like-for-like reasoning.

Model 3, Model Y and Model X: matching your car

The starting point is your own car's build sheet. Before you call anyone, open the Tesla app or your account and note the model, variant, drivetrain, seat count and any options that matter to you, such as seven seats, tow hitch or performance brakes. That list is what the replacement is matched against.

Here is how the three common cases map across:

A 2025 Model Y RWD is a current-shape electric SUV based at Merrylands, with 220 kW and 420 Nm, rear-wheel drive and five seats. It is the natural match for a Model Y owner whose car is in a Parramatta or Merrylands repairer. Minimum driver age is 25.

Charging a replacement Tesla around Sydney

This is the question every Tesla owner asks first, and the answer is straightforward: the replacement car comes with the same charging setup as your own. You charge at home on your wall connector if you have one, at a destination charger, or at a Supercharger. The car's navigation plans the stops for you, and the app shows live availability.

Practical notes for Sydney:

  • Superchargers are busiest on Friday afternoons and Sunday evenings. If you are heading south on the Princes Highway or north on the M1, charge before you leave rather than at the first stop.
  • Broadway, Chatswood, Alexandria and Casula are the sites most Sydney owners use. Expect a wait at Broadway around lunchtime on weekends.
  • If you cannot charge at home, a standard 10 amp wall socket adds roughly 10 to 12 kilometres of range per hour. Overnight that is usually enough for a daily commute.
  • Return the car at the state of charge you received it in. The handover sheet will note it, and photograph the screen before you drive away.

Charging costs are part of running the replacement. Keep the receipts or the app statements; they are a legitimate running cost of the substitute vehicle while yours is off the road. Do not let a well-meaning friend or a tow operator talk you into a petrol rental because they think charging is complicated. It is not, and the like-for-like argument is weaker once you have accepted a different drivetrain.

If you are new to the process, our guide to how credit hire works explains who pays for what and when.

Delivery to Merrylands, Parramatta and your repairer

A replacement Tesla is usually delivered to you, not collected from a counter. In western Sydney, the practical handover points are Merrylands and Parramatta, and delivery can be arranged to your home, your workplace or directly to the smash repairer so you can swap cars on the spot.

Timing matters. Most repairers in the Parramatta, Granville, Auburn and Blacktown corridor want the damaged car in first thing in the morning so it can be assessed and put in the queue the same day. If your car is being towed to a repairer in Silverwater or Smithfield, arrange the replacement to meet you there. The tow operator can wait while you move your belongings across.

What to have ready at handover:

  1. Your driver licence, current and in the same name as the hire agreement.
  2. A credit or debit card in your name for the bond and any incidentals.
  3. The police event number from the crash report.
  4. The other driver's name, insurer and claim number if you have them.
  5. Your own car's details, including variant and options.

Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group. When you are ready to arrange the car, the booking is made through the car's page, and the rate, the bond and every fee are shown before payment.

If you are in the first day after the crash, work through our first 24 hours guide before you start calling insurers. It lists the calls in the right order.

What to check before you drive away

Ten minutes of checking at handover saves an argument at return. Walk the car with the person delivering it, in daylight if you can, and photograph everything.

  • Every panel, bumper and wheel for existing scratches, kerb rash and dents. Photograph each one close up and wide.
  • Windscreen for chips, and the roof glass if fitted.
  • Tyre tread and pressures. A performance Tesla eats rear tyres; note the condition.
  • State of charge, and photograph the screen showing the percentage and estimated range.
  • Odometer reading, photographed.
  • That the charging cable and any adapters are in the boot or under the floor.
  • That the key card and any phone key setup work before the delivery person leaves.
  • That the software is updated and the car is not in a restricted mode.
  • Child seats, if you use them, are fitted and correct for the car.

Then read the hire agreement before you sign. Check the rental period, what happens if the repair runs longer, how to extend, the excess you have chosen, and the fuel or charge policy. Paying by card carries a small surcharge; bank transfer and cash on the rental do not. The bond equals the excess you choose.

If anything on the car is not as described, say so before you drive away and get it noted on the handover sheet. A photo on your phone with the timestamp is enough.

How long Tesla repairs take and why

Tesla repairs in Sydney take longer than a conventional car for reasons that have nothing to do with the workshop's speed. Parts come from a limited number of distribution points, and some panels and structural components are not stocked locally. A rear quarter panel or a structural rail can add weeks while it is ordered and shipped.

Typical patterns in the Sydney market:

  • Bumper and paint work: one to two weeks, subject to parts.
  • Panel replacement with structural repair: three to six weeks.
  • Battery or high-voltage work: longer, and only at approved facilities.
  • Write-off assessment: adds time before any repair starts.

Aluminium-intensive Teslas also need repairers with the right equipment and training. Not every shop in the Parramatta or Blacktown corridor is set up for it, so your car may travel further than you expect. That is another reason the replacement needs to be arranged for the whole repair period, not a week at a time.

Keep the pressure on with documentation rather than phone calls. Ask the repairer for a written estimate of the repair duration and update it if parts are delayed. Send that to the insurer and to the credit hire provider. If the repair is going to run long, extend the hire early rather than on the day it expires.

Our page on how long prestige car repairs take in Sydney goes into more detail, and repairs and write-offs covers what changes if the car is declared a total loss.

The hire agreement and what you sign

Credit hire means the replacement is provided now and the cost is recovered later from the at-fault party's insurer. You sign a hire agreement, and in most cases you also sign an authority that lets the provider deal with the insurer on your behalf. Read both.

What the agreement should tell you plainly:

  • The daily rate and the total estimated hire cost.
  • The bond, which equals the excess you choose, and when it is refunded.
  • The excess options available and what each one means if the replacement is damaged.
  • Who is liable if the claim is not recovered, and on what grounds.
  • The hire period and how to extend it.
  • What you must do: cooperate with the claim, provide documents, attend the repairer if asked.

You are not borrowing a favour. You are using a lawful recovery mechanism, and the paperwork exists to protect both sides. If a clause is unclear, ask before signing. If you are a business running a fleet, the same structure applies, and our business and fleet page covers how multiple vehicles are handled.

Keep your own file: the police event number, the other driver's details, photos of both cars, the repairer's estimate and every email. That file is what wins a disputed claim.

If the insurer disputes the replacement

Insurers dispute replacement hire for predictable reasons: they say the hire rate is too high, the period is too long, or a cheaper car would have done. None of those arguments automatically defeat a like-for-like claim, but they do need answering with evidence rather than indignation.

What actually helps:

  1. A written statement of your car's specification and why the replacement matches it.
  2. The repairer's written estimate of repair duration, updated when it slips.
  3. Evidence that a comparable Tesla was not available more cheaply at the time.
  4. Prompt responses to every request, so the insurer cannot claim delay.

Most disputes are resolved between the credit hire provider and the insurer without you in the middle. Your job is to keep the documents moving and to tell the provider immediately if the insurer contacts you directly with a settlement offer that includes the hire cost. Do not accept a cheque for the car and assume the hire is covered; they are separate heads of loss.

If the matter escalates, a solicitor who handles motor vehicle property damage can advise on your position. This article is general information, not legal advice, and you should talk to your solicitor about your own circumstances.

Questions people ask

Will the replacement Tesla have Supercharger access?
Yes. A replacement Tesla is a normal Tesla, so it charges on the Supercharger network and at destination chargers, and the car's navigation plans the stops for you. You can also charge at home on a wall connector or a standard socket. Photograph the state of charge at handover and return the car at the same level. Keep your charging receipts or app statements, because they are a legitimate running cost of the substitute vehicle while your own car is off the road.
Can I get a Model X as a replacement for a Model X?
If your own car is a Model X, a Model X is the natural like-for-like match, particularly where you have the seven-seat layout. Availability varies, so tell the provider your exact variant and seat count at the first call. If a Model X is not available immediately, the provider should explain what comparable electric SUV is being offered and why, and you can push back if the substitute is materially smaller or slower than your car.
How do I prove my Tesla was not at fault?
The police event number is the anchor. Report the crash, get the event number, and record the other driver's name, licence, registration, insurer and claim number. Photograph both cars, the position of the vehicles, the road and any dashcam footage. Tesla's own camera system may have saved clips, so check the dashcam folder in the car before the vehicle goes to the repairer. Send everything to your insurer and to the credit hire provider in one file.
Can I arrange a replacement Tesla if my car is a write-off?
Yes, though the structure changes. While the write-off is being assessed you still need transport, and a replacement can be arranged for that period. Once the car is declared a total loss, the claim shifts to the value of the vehicle rather than the repair, and the hire period is usually shorter. Tell the provider as soon as the assessor indicates a write-off, so the hire is managed to the right end date rather than extended unnecessarily.
What do I need at handover for a replacement Tesla?
Bring your current driver licence in the same name as the hire agreement, a credit or debit card in your name for the bond, the police event number, and the other driver's details if you have them. Have your own car's model, variant and options ready so the match can be confirmed. Walk the car with the person delivering it, photograph every panel, wheel and the odometer, and check the charging cable is present before they leave.
Does it matter which repairer my Tesla goes to?
It does. Tesla repair work needs the right equipment and training, and not every shop is set up for aluminium-intensive structural repair. Your car may need to go further than the nearest repairer in the Parramatta or Blacktown corridor. That affects the repair duration, and therefore the hire period, so ask for a written estimate of how long the repair will take and keep it updated if parts are delayed.
