Tesla replacement car when you are not at fault

If someone else caused the crash, you can usually keep driving a Tesla while yours is repaired, and the at-fault driver's insurer normally picks up the reasonable cost of a like-for-like replacement. In New South Wales that principle comes from the Court of Appeal decision in Arsalan v Rixon, which confirmed that a not-at-fault driver is entitled to be put back in the position they were in before the crash, not merely given basic transport.
For a Tesla owner that means an electric replacement, not a petrol SUV. This guide covers the Model 3, Model Y and the seven-seat Model X, how charging works while you have the replacement, what insurers actually say about EV hire rates, repair timelines in Sydney, and how delivery to Parramatta, Merrylands and the surrounding suburbs works.
Key takeaways
- If the crash was not your fault, you are generally entitled to a like-for-like replacement, and for a Tesla owner that means an electric car, not a petrol SUV.
- The Model 3 Performance, Model Y RWD and seven-seat Model X cover most Tesla replacement needs, with minimum driver ages of 20, 25 and 20 respectively.
- Charging at home works the same as it does with your own car, and public fast chargers along the M4 and M5 corridors cover longer trips.
- Tesla repairs in Sydney often take longer than mainstream cars because of parts availability and camera recalibration.
- Credit hire lets you get moving before the at-fault insurer accepts liability, and the hire period should track the repair, not a fixed number of days.

Why an EV owner needs an EV replacement, not a petrol SUV
Handing a Tesla owner the keys to a petrol SUV is not like-for-like. Your car is charged at home overnight, it costs a fraction of petrol to run, it has no gears, and it is quiet enough that you notice road noise on the M4 at 100 km/h. A petrol replacement changes your daily routine, your fuel budget and, for many people, your ability to use tolls, transit lanes and charging that is already set up at home.
Like-for-like does not mean identical. It means comparable in size, prestige, performance and practicality. A Model 3 Performance owner should not be handed a base Corolla. A Model Y family doing the school run through Parramatta and Carlingford needs the same boot space for prams and sport bags. A Model X owner with seven seats in use needs seven seats.
The other reason is safety and familiarity. If you have been driving an EV for years, the regenerative braking, one-pedal driving and screen-based controls are second nature. Putting you in an unfamiliar petrol car for three weeks adds risk at exactly the time you are already stressed.
If you want the legal background, our page on not-at-fault explained sets out the entitlement in plain English, and like-for-like covers how replacement vehicles are matched.
Model 3, Model Y and Model X: matching the right one
There is no single Tesla replacement. The right car depends on what you were driving and what you actually do with it.
Model 3
The Model 3 is a sedan, so if your car is a sedan, the match is straightforward. The Performance variant adds a second motor and considerably more power, which matters if your own car is a performance model and you want the replacement to feel equivalent. Minimum driver age on the Model 3 Performance is 20, and it is based in Parramatta.
Model Y
The Model Y is the SUV body, with a higher seating position and a large boot. The RWD version is rear-wheel drive with 220 kW and 420 Nm, and it reaches 100 km/h in 5.9 seconds, which is brisk without being a performance car. It seats five. Minimum driver age is 25, and it is based in Merrylands.
Model X
The Model X P100D is the seven-seat car. It is all-wheel drive, with 568 kW and 967 Nm, and it reaches 100 km/h in 3.1 seconds. If your household genuinely uses seven seats, this is the one that keeps the week running. It can be self-drive or chauffeured, and minimum driver age is 20.
If your crash involved a larger family SUV, our seven-seat SUV replacement page compares the alternatives.

Age limits are set per car. Drivers under 25 can hire most cars with Young Driver Cover; the exact terms are shown before you pay.
Charging at home and on the road while you have the replacement
Charging is the question every Tesla owner asks first, and it is easier than most people expect. If you have a wall charger or a 10-amp outlet at home, you can charge the replacement the same way you charge your own car. Nothing about the hire car prevents it.
If you live in an apartment in Parramatta, Rhodes or Wentworth Point and rely on public charging, tell us when you book. We can factor that into which car suits you and how you plan your week. Sydney has a good spread of fast chargers along the M4 corridor, the M5 and the Pacific Highway, plus destination chargers at shopping centres in Burwood, Chatswood and Liverpool.
A few practical habits help:
- Charge overnight at home whenever you can, even on a standard outlet. It covers most daily driving.
- Use a DC fast charger when you are already stopping for coffee or shopping, not as a special trip.
- Keep the car between roughly 20 and 80 per cent for daily use, and charge to full only before a long drive.
- If you are heading to the Blue Mountains or the Central Coast, plan one top-up each way.
You do not need to return the car fully charged, but leaving it with a reasonable charge is courteous and avoids awkward conversations at handover.

Start my claimThe seven-seat Model X and family logistics
The Model X is the one that solves a genuine problem. If you have three children in car seats, or you regularly carry grandparents, teammates or work crew, a five-seat replacement does not work. You end up doing two trips to Saturday sport at Homebush, or you leave someone at home.
Seven seats also matter for the school run. Dropping three kids at three different schools between Merrylands, Granville and Parramatta is a real sequence, and it only works with the right car. The Model X handles it without you having to reorganise your entire week.
Two things to plan around. First, the third row is best for children and shorter trips; adults will find it tight on a long drive to Newcastle. Second, with all seven seats up, luggage space is limited, so if you are doing an airport run to Mascot with a full car, pack accordingly.
The Model X is also available chauffeured, which suits corporate guests, wedding parties and anyone who would rather not drive after a stressful week. Minimum driver age is 20, and it is based in Merrylands with delivery available.
Our people mover replacement page covers the alternatives if your own car is a van rather than an SUV.
What insurers say about electric vehicle hire rates
Insurers do not refuse EV replacements as a matter of policy. What they push back on is the daily rate, particularly for higher-end electric cars, and they will sometimes argue that a cheaper petrol car would have done the job. That argument is weaker than it sounds, because the test is what is reasonable for you, not what is cheapest for them.
In practice, the conversations go more smoothly when three things are clear from the start:
- The replacement is genuinely comparable to your car in size, prestige and performance.
- The hire period matches the repair period, not an arbitrary number of days.
- The evidence is clean: photos, the police report if one was made, the other driver's details, and a repairer's assessment of how long the work will take.
Credit hire is the mechanism that lets you get moving before the at-fault insurer has accepted liability. You do not pay upfront, and the claim is pursued against the at-fault party. Our how credit hire works page explains the process step by step, and credit hire versus paying yourself compares the two routes honestly.
If the insurer is slow to respond, our page on insurer delays covers what to do next.

Repair timelines for Teslas in Sydney and parts availability
Tesla repairs in Sydney generally take longer than a comparable Toyota or Mazda, and the reason is parts, not labour. Panels, lights, sensors and structural components often come from interstate or overseas, and a car can sit at the repairer waiting on a single bracket.
Typical patterns we see:
- Cosmetic panel and bumper work: often two to four weeks, longer if a sensor or camera needs recalibration.
- Structural repair after a heavier hit: frequently six to twelve weeks, depending on parts.
- Anything involving the battery pack or high-voltage system: expect a specialist assessment and a longer timeline again.
Calibration matters on Teslas. Cameras and radar feed driver assistance systems, and after a windscreen or bumper replacement the car needs recalibration with the right equipment. Not every smash repairer has it, so ask before you book the repair.
Sydney-specific friction points include tow and storage at busy periods, and repairer queues after a run of wet weather. If your car is towed to a holding yard in Western Sydney, get it to your chosen repairer quickly so the assessment can start.
Our how long prestige repairs take page has more detail, and repairs and write-offs covers what happens if the car is declared a total loss.

Tesla Model Y RWD 2025
The updated Tesla Model Y is the easiest way to try electric driving: quiet, quick off the line and packed with technology, with a huge boot and a panoramic glass roof. Plenty of...
Delivery to Parramatta, Merrylands and surrounds
Both the Model Y and the Model X are based in Merrylands, and the Model 3 Performance is based in Parramatta. That makes delivery quick across the Parramatta, Cumberland and Hills corridors.
Realistically, we can get a car to you the same day or the next day in most of these suburbs:
| Suburb | Typical delivery |
|---|---|
| Parramatta, Westmead | Same day in most cases |
| Merrylands, Granville, Guildford | Same day in most cases |
| Blacktown, Seven Hills, Baulkham Hills | Same or next day |
| Strathfield, Burwood, Lidcombe | Next day |
| CBD, North Sydney, Mascot | Next day, traffic dependent |
Delivery is available on all three cars. You will need your licence, proof of the incident and the other driver's details. If your car is at a repairer or a tow yard, we can often meet you there instead.
Bookings are fulfilled by Drive Tribe (drivetribe.com.au), the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group. You can see live availability and book directly through the car pages.

Returning the car and finalising the hire period
The hire period should track the repair, not a fixed number of days. When your car is ready, the replacement goes back. If the repair runs long because a part is delayed, the hire extends, and that extension is part of the claim.
A clean handover needs a few things:
- Photos of the replacement at drop-off, including the odometer and charge level.
- The repairer's completion date in writing.
- A record of any tolls or fines incurred during the hire, so they can be sorted quickly.
- Confirmation of where the car is being returned, which can be our base or your repairer.
If your car is written off rather than repaired, the hire usually ends when the payout is settled and you have replacement transport. Our repairs and write-offs page explains how that timeline works.
Do not hand the car back early just to be polite. If your repairer says Friday and the car is not ready until the following Wednesday, keep the replacement until Wednesday. The at-fault insurer is responsible for the reasonable period, and cutting it short only costs you.
If you are running a business and need the car for client meetings, our business and fleet page covers how we handle multiple vehicles and longer hires.
What to do in the first 24 hours after a not-at-fault crash
The first day sets up everything that follows. Get these done and the rest is much easier.
- Make sure everyone is safe and call 000 if anyone is injured.
- If police attend, get the event number. If they do not attend, you can still report the incident online.
- Photograph everything: both cars, the position on the road, street signs, skid marks, and the other driver's licence and registration.
- Collect the other driver's name, address, phone number, licence number and insurer if they will give it.
- Note the time, the weather and the traffic conditions while it is fresh.
- If there are witnesses, get a name and number.
- Call us or book online so a replacement can be arranged.
Do not admit fault, even casually. Do not agree to a cash settlement at the roadside. Do not let the other driver's insurer talk you into a repairer you do not want.
Our evidence to collect at the scene page has the full checklist, and what not-at-fault means in NSW explains the legal position clearly.
