Credit hire after a crash on the M4 when towing a caravan

If the other driver caused the crash, you can usually hire a like-for-like replacement tow vehicle on credit hire and recover the cost from the at-fault insurer, and the caravan damage is dealt with as property damage under the same claim. The tow vehicle comes first, because without it the van is going nowhere.
This page is the towing-specific version of how credit hire works: what changes when a caravan is on the hitch, who pays for what, how long it takes, and what to do in the first day.
Key takeaways
- If the other driver was at fault, credit hire can cover a like-for-like replacement tow vehicle, and the caravan is dealt with as property damage in the same claim.
- The replacement must actually be able to tow your van, which means a suitable tow rating, a fitted tow bar, and often a brake controller.
- Tell the provider your van's ATM and GTM up front, because the at-fault insurer will use any mismatch to dispute the hire.
- Expect the other driver's insurer to probe your load, your tow ball weight and your van's condition when fault is contested.
- A written-off caravan does not automatically end the tow vehicle hire, but the at-fault insurer will argue it should be downgraded or stopped.

Why towing crashes on the M4 are different
The M4 between Parramatta and the Blue Mountains is where a lot of Sydney's caravan traffic funnels through. Long grades, 100 km/h limits, and a mix of B-doubles, tradie utes and holidaymakers. Add a van on the back and the physics change: braking distances stretch, crosswinds at the Wallgrove Road interchange push you around, and a sudden lane change by a car in your blind spot can put you into a sway you cannot steer out of.
Three things make these crashes harder than a normal rear-ender:
- Two damaged assets. The tow vehicle and the caravan are separate items of property, often insured by different policies, sometimes with different insurers.
- Load and towing questions. The other driver's insurer will look for any reason to shift blame: was the van overloaded, was the tow ball weight right, were the electrics working, was the sway control on.
- Replacement complexity. A like-for-like replacement is not just any 4WD. It needs a tow bar, a suitable tow rating, and often a brake controller and mirrors.
None of that changes the core rule. If the other driver was at fault, you are entitled to be put back where you were, and that includes the ability to tow. The practical question is how you get there without paying up front.
What to do when your caravan is damaged in a crash
Work through this in order. It matters later.
- Stop safely and get off the road. On the M4, that usually means the shoulder or the emergency lane. Put hazards on and get everyone behind the barrier.
- Call 000 if anyone is hurt. Otherwise call the police assistance line and report it. A crash involving a towed vehicle and a blocked lane is worth a report.
- Photograph everything before it is moved. Wide shots showing lane position and skid marks, close shots of the tow bar, the hitch, the safety chains, the van's A-frame, the coupling, and the damage on both vehicles. Photograph the other driver's plates and their licence.
- Get the other driver's details. Name, address, licence number, insurer if they know it, and their phone number.
- Do not admit fault. Give facts, not opinions. "He changed lanes into my van" is a fact. "Sorry, I should have braked" is not.
- Call your insurer to notify, even if you are not claiming on your own policy.
- Call a credit hire provider the same day if you need the tow vehicle replaced. The first 24 hours are covered in more detail at first 24 hours.
If the van is not driveable, arrange a tow to a secure yard or your repairer. Do not let it sit on the M4 shoulder overnight.

Age limits are set per car. Drivers under 25 can hire most cars with Young Driver Cover; the exact terms are shown before you pay.
Who pays for the caravan and the tow vehicle
Two separate heads of damage, one claim against the at-fault driver.
The tow vehicle. If it is not driveable, you are entitled to a replacement that does what yours did. That means a 4WD or ute with a suitable tow rating and a tow bar, not a Corolla. The at-fault insurer is liable for the reasonable cost of that replacement while yours is off the road.
The caravan. The van is property damage. Repair or replacement cost is recoverable from the at-fault driver or their insurer, subject to the usual rules about betterment and market value. If the van is your home away from home and you had a trip booked, you may also have a claim for consequential loss, but that is a legal question, not a hire question, and you should talk to a solicitor about it.
Your own policy. If your comprehensive policy covers the van, you can claim on it and let your insurer chase the at-fault driver. That is often faster for the van itself. It does not stop you using credit hire for the tow vehicle.
Be careful about double-dipping. You cannot recover the same loss twice. Tell the credit hire provider what you are claiming on your own policy so the two do not collide.

Start my claimGetting a replacement 4WD that can tow
This is where most credit hire arrangements fall down. The provider sends a Camry, you cannot move the van, and the whole point of the hire is lost.
What you actually need:
- A 4WD or ute with a braked tow rating that covers your van's loaded weight, not its tare weight.
- A tow bar fitted and rated, with a tow ball and a D-shackle or suitable recovery points.
- A trailer plug wired for your van, ideally 12-pin if the van needs it.
- A brake controller if your van is over the threshold that requires one, which most large vans are.
- Towing mirrors if the van is wider than the vehicle.
- Enough payload for your family and gear.
Tell the provider the van's ATM and GTM at the time of booking. If you do not know them, the compliance plate on the A-frame has them. Getting this wrong is the single most common reason a replacement tow vehicle is rejected by the at-fault insurer as unreasonable.
For utes that will actually do the job, these are on the fleet:

All three are 4WD, seat five, and are available with delivery. The Silverado has the most torque of the three, which matters on the M4 climbs out of Penrith and up Lapstone. The HiLux and Ranger are the more common tow rigs and are easier to match like-for-like if your own vehicle is a dual-cab.

How credit hire works when you need a tow bar
Credit hire is straightforward in principle. You are not at fault, you do not pay up front, and the hire company recovers the cost from the at-fault insurer or the at-fault driver. You sign an agreement, take the vehicle, and return it when your own is repaired or settled.
The tow bar adds a few steps:
- Approval for the tow bar itself. Fitting a tow bar is a modification. Some credit hire providers will only supply a vehicle that already has one, because fitting one to a hire car is expensive and slow.
- Approval for the tow rating. The at-fault insurer will want to see that the replacement is reasonable. A 3.5 tonne van behind a vehicle rated to 2.5 tonnes is not reasonable, and they will push back.
- Approval for the duration. Towing vehicles are often needed for longer than a normal replacement, because van repairs can drag. Keep the provider informed.
- What you sign. The agreement usually includes an authority for the provider to recover from the at-fault party, and a fallback that you may be liable if recovery fails. Read it. The paperwork is explained at what you sign credit hire paperwork.
If the at-fault insurer disputes the hire, the dispute is between the provider and the insurer, not you, provided you have been straight about the facts. See when an insurer disputes a credit hire claim.

What happens if the caravan is a write off
A written-off caravan is a different problem from a written-off car. The van is usually repaired or replaced by whoever insures it, and if you are not at fault, you can pursue the at-fault driver for the market value.
Three scenarios:
| Scenario | What usually happens |
|---|---|
| Van insured, you claim on your own policy | Your insurer pays you out and chases the at-fault driver. Fastest route, but you may lose your no-claim bonus until recovery. |
| Van insured, you claim on the at-fault policy | Their insurer assesses, offers market value, you negotiate. Slower but no impact on your policy. |
| Van uninsured | You pursue the at-fault driver directly. Get legal advice early. |
What a write-off does to your replacement hire: the tow vehicle hire continues while your tow vehicle is being repaired or replaced. The van being written off does not automatically end the tow vehicle hire, but if the van is gone and you no longer need to tow, the at-fault insurer will argue the hire should stop or downgrade. Be ready for that conversation.
More on this at credit hire and write-offs and repairs and write-offs.
Proving fault when the other driver blames your load
Expect this. When a caravan is involved, the other driver's insurer will often argue that your load, your speed, or your van's condition contributed.
What actually decides fault in NSW:
- Who had the obligation and breached it. A lane change into your path is on them. A failure to give way is on them. Your load only matters if it caused or contributed to the crash.
- Independent evidence. Dashcam footage is gold. So are witness statements and the police report. Get them early.
- Vehicle condition. If your van had a defective coupling or your brake controller was not working, that will be raised. Keep your service records.
- Loading. If you were within your ATM and GTM and your tow ball weight was within spec, you are on solid ground. If you were over, expect a fight.
If fault is disputed, the credit hire provider may still fund the hire while the dispute runs, but you should understand the risk. The general position is set out at insurer disputes hire car claim and dealing with insurers.
If the dispute looks serious, talk to a solicitor who does motor accident work. This page is general information, not legal advice.
How long the whole thing takes
Realistic timelines for a towing crash on the M4, assuming the other driver is insured and fault is not disputed:
- Replacement tow vehicle: usually same day or next day if a suitable vehicle is available. Getting one with a tow bar already fitted is the bottleneck.
- Tow vehicle repairs: one to three weeks for panel work, longer if there is chassis or suspension damage.
- Caravan repairs: four to twelve weeks. Van repairers are fewer and busier than car repairers, and parts often come from interstate.
- Settlement of the van claim: two weeks to three months if it is a write-off and you are negotiating market value.
The tow vehicle hire usually ends when your tow vehicle is repaired or when the claim settles, whichever is relevant. If the van is still being repaired and you still need to tow, say so early and in writing.
For the broader sequence, see credit hire timeline from crash to settlement.
Booking a replacement tow vehicle
Have these ready before you call or book online:
- The other driver's name, licence number, insurer and claim number if you have it.
- The police report number.
- Photos of the damage to both vehicles and the van.
- Your van's ATM and GTM from the compliance plate.
- Your tow vehicle's make, model and tow rating.
- Your repairer's details and an estimated repair window.
Vehicle delivery is available across Sydney, including to repairers and to homes in the Merrylands and Parramatta area, which suits if your tow vehicle was towed there after the crash. Minimum driver age is 25 on the tow-capable utes listed above. The rate, the bond and any fees are shown on the car's page before payment. Paying by card carries a small surcharge, while bank transfer and cash on the rental do not. Cars can be booked from a single day.
If you are booking for a business or fleet, the process is slightly different and is covered at business and fleet. If you are a repairer or solicitor referring a client, see partners and referrals.
