Credit hire when you need a specific type of car

If your car has seven seats, a tow bar, a tray or a child restraint anchor, the replacement has to do the same job, not just look similar. Credit hire is how a not-at-fault driver gets a like-for-like vehicle while the at-fault insurer picks up the reasonable cost.
This guide is for Sydney drivers of prestige and performance cars who have been hit and need a specific replacement car after an accident. It covers what like-for-like really means when your car works for a living, how to evidence the requirement, and what to do when your exact model is not on the fleet.
Key takeaways
- Like-for-like means the replacement does the same job as your car, not that it is the same model.
- Seats, trays, tow bars, child anchors and home charging are requirements and should be evidenced with photos and a short note.
- You are not entitled to your exact model, but you are entitled to a comparable vehicle that meets your ranked requirements.
- Insurers dispute unsupported requirements, not reasonable ones, so keep the evidence factual and specific.
- Bookings are fulfilled by Drive Tribe, the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group.
- What like for like actually means when your car does a job
- Seven seats and school runs
- Utes, trays and tradie loads
- Tow bars, caravans and boat ramps
- Electric cars and charging at home
- Child restraints and anchor points
- What to do when your exact model is not available
- Evidence that supports your requirement
What like for like actually means when your car does a job
Like-for-like is not a colour match. In New South Wales the test comes from the reasoning in Arsalan v Rixon: a not-at-fault driver is entitled to be put back in the position they would have been in but for the collision, and that can include the cost of hiring a replacement vehicle of a comparable kind. If your car had a tow bar because you tow a boat to Rose Bay, a replacement without one does not restore your position.
So the practical question is not what badge is on the boot. It is what the car did last week. Did it carry five kids to Saturday sport at Centennial Park? Did it pull a trailer of tools to a site in Alexandria? Did it get charged overnight in your garage at Castle Hill? Those are requirements, and credit hire providers assess them the same way a loss adjuster does: on evidence.
Two drivers can have the same model and different entitlements. A ute that only ever did the school run is a different claim from a ute that towed a bobcat five days a week. Your replacement needs to match the job, not the brochure.
Start with the plain-English version of like-for-like replacement, then look at how the claim is actually funded in how credit hire works. If you are still working out fault, read not at fault explained first.
Seven seats and school runs
A seven-seat requirement is one of the easiest to evidence and one of the most common in Sydney's north and west. If you have three children in the back and one in a capsule, a five-seat sedan does not get you to Loreto Kirribilli or Knox at 8am. It leaves a child at home.
Insurers sometimes push back with a five-seat SUV because it is the same size class on paper. The answer is a photo of your car with all seats occupied, the rego, and the school run described in one sentence. That is usually enough.
Three rows also matter for trades and carers. A plumber carrying an apprentice and gear, or a support worker moving clients, needs the seats, not just the space.
If you need three rows, the fleet has options that actually do the job:
- Mercedes-Benz GLS, seven seats, all-wheel drive, diesel, based at Mascot, minimum driver age 20
- Kia Carnival GT-Line, eight seats, hybrid, based at Mascot, minimum driver age 20
Both are self-drive with delivery available, which matters when you are juggling repairs, a hire car company and a school pickup in the same week.

Utes, trays and tradie loads
A ute is a tool. If your Ranger, Hilux or Shark carried a ladder rack, a toolbox and a load of timber, a small SUV is not a replacement, it is a shutdown. The tray is the requirement, and the payload and towing capacity come with it.
Sydney specifics matter here. A dual-cab ute that fits a standard car space at Westfield Parramatta is not the same as a single-cab tray that has to reverse into a tight driveway at a Paddington terrace. Tell the provider what you actually carry and where you park.
Two things to have ready:
- A photo of the ute loaded, with the tray in view.
- A short note on what you carry and how often, including any trailer or machine.
If you run a fleet, the claim is usually handled differently to a private one. See business and fleet and credit hire for business and fleet cars.
For a tray that has to work, the fleet has two utes based at Merrylands, both with delivery available:
- Ford Ranger Wildtrak 4x4, diesel, 4WD, five seats, minimum driver age 25
- BYD Shark 6 Premium, plug-in hybrid, all-wheel drive, five seats, minimum driver age 20

Not at fault? Start your claim
A like-for-like replacement car while yours is repaired. No cost to you when the other driver is at fault.
Start my claimTow bars, caravans and boat ramps
Tow bars are the classic like-for-like argument. If your car has a tow bar and a rated towing capacity, and you tow a caravan to Wisemans Ferry or a boat to the ramp at Rose Bay, a replacement without a tow bar does not restore you. The insurer will often say you can hire a tow bar separately. That is not the point: the car you had was already set up, and the replacement should be too.
What to evidence:
- A photo of the tow bar on your car, showing the ball and the wiring.
- The towed item: caravan, boat, trailer, box trailer, or a work trailer.
- Where you tow, how often, and whether it is seasonal.
If the replacement car can be fitted with a tow bar, ask whether the fitting is included. If it cannot, the requirement is not met and the provider should look for something that can.
Be careful with weight. A plug-in hybrid or electric ute may have a lower braked towing capacity than the diesel you had. If your caravan is heavy, say so at the start, because the wrong replacement becomes a safety issue on the M1 at Berowra.
If towing is part of your routine, read replacement by car type before you accept anything.
Electric cars and charging at home
If you drive an EV and charge at home, a petrol replacement changes your week. It is not just fuel cost. It is the routine: plugging in at night, waking to a full battery, and never queuing at a servo on the way to the office.
You can ask for an electric or plug-in hybrid replacement, and a plug-in hybrid ute like the BYD Shark 6 Premium sits in the fleet for exactly this reason. But be realistic about what is available and about your charging setup. If your home charger is a wall box in the garage, a replacement with a different plug or no fast charging may not suit.
What to tell the provider:
- Your usual charging routine and where you charge.
- Your daily distance, roughly, and any long trips planned.
- Whether you have a wall box or only a standard outlet.
Do not overstate it. If you charge once a week at a shopping centre, say that. If you do 120 kilometres a day, say that too. The claim is stronger when the requirement is specific and true.
For the wider picture on how these claims are funded, read how credit hire works.

Child restraints and anchor points
Child restraint anchors are a requirement, not a preference. If your car has ISOFIX points or top tether anchors and you have a rear-facing capsule, a replacement without them cannot legally or safely carry your child. That is one of the clearest like-for-like arguments there is.
In New South Wales, child restraints must be fitted and used correctly, and the anchor points are part of that. A hire car with no anchor points is not a replacement for a family car. It is a problem.
What to have ready:
- A photo of the restraint fitted in your car, showing the anchor or ISOFIX points.
- The number and ages of children who travel regularly.
- Whether you need a third row for a booster or capsule.
If the replacement has the seats but not the anchors, say so before you accept it. If it has the anchors but the wrong configuration, say that too. A seven-seat SUV with two top tethers in the third row is different from one with none.
If your car is also your work car, business and fleet covers how those claims are handled.
What to do when your exact model is not available
You are not entitled to your exact model. You are entitled to a comparable vehicle that does the same job. That distinction matters when your car is rare, newly released, or simply not on any fleet in Sydney.
Work through it in this order:
- List the requirements, not the badge: seats, tray, towing, anchors, drivetrain, charging.
- Rank them. Which one, if missing, actually stops your week?
- Accept the closest match that meets the ranked requirements.
- If nothing local meets them, ask about delivery or a short wait.
A prestige or performance car adds a wrinkle. If your car was a BMW M or an AMG, a standard SUV may not be comparable on power or specification. See credit hire for prestige and performance cars and BMW M and AMG replacement cars.
If the insurer disputes the replacement, when an insurer disputes a credit hire claim sets out the usual arguments and how they are answered.
Bookings are fulfilled by Drive Tribe (drivetribe.com.au), the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group. You can see the not-at-fault process at not at fault accident replacement.
Evidence that supports your requirement
Insurers do not reject requirements. They reject unsupported ones. A clear photo and one sentence beat a long explanation every time.
What to collect in the first day or two:
| Requirement | Evidence |
|---|---|
| Seven seats | Photo of all seats occupied, plus a note on who travels |
| Tray or ute | Photo of the loaded tray, plus what you carry |
| Tow bar | Photo of the bar and ball, plus the towed item |
| Child anchors | Photo of the fitted restraint and anchor points |
| EV charging | Photo of your home charger, plus daily distance |
Keep it factual. Do not inflate the requirement, because a disputed claim is slower for everyone, including you. If you have a fleet, the same evidence goes to your fleet manager or broker, and partners and referrals explains how repairers and solicitors refer these claims.
If you are still in the first day, start with first 24 hours. If the car may be written off, read credit hire and write-offs before you agree to anything.
