If you have been hit on the M1 Pacific Motorway and you are not at fault, the at-fault driver's insurer is generally liable for your loss of use, and in NSW that loss is measured by what a court would award for a replacement car of similar quality and performance to the one you lost. You do not have to accept a small hatchback while your prestige car sits in a repairer.

The M1 is the worst place in the state to be stranded, because the crash is usually far from home and far from your repairer. This page covers what to do on the shoulder near Berowra or Mount White, how to exchange details with a driver from interstate or a rental, where the car gets towed, and how a like-for-like replacement reaches your driveway on the Central Coast or the North Shore.

Key takeaways

  • If you are not at fault, the at-fault driver's insurer is generally liable for your reasonable loss of use, including a replacement car of similar type and quality.
  • The M1 between Berowra and Mount White is the worst stretch for being stranded, so decide on a repairer and a tow destination within 48 hours.
  • Interstate and rental at-fault drivers do not change your rights: the crash happened in NSW, so NSW law applies.
  • You should never pay the hire rate, the tow or the storage on a properly run not-at-fault claim; you pay the bond and a card surcharge if you use a card.
  • Prestige repairs on the M1 corridor commonly take two to four weeks, mostly because of parts, so plan for a replacement car over that period.

Why M1 crashes leave drivers stranded

The M1 is a 127 kilometre run from Sydney to Newcastle, and the section that catches out Sydney and Central Coast drivers most often is the stretch between the Hawkesbury River and Berowra. It is three lanes each way, 110 km/h, with the Mooney Mooney and Mount White grades, and it is the only realistic road between the Central Coast and the North Shore. There is no convenient parallel route. If your car is undriveable at Mount White at 7.40am, you are roughly 50 minutes from Hornsby and over an hour from Gosford in traffic.

Two things follow. First, a tow is almost always necessary, and the tow operator will usually want to take the car to the nearest holding yard rather than your chosen repairer. Second, the driver is left standing on a narrow shoulder with no way home and no way to work. That is the moment the at-fault insurer's obligation to cover your loss of use matters, because the practical loss is not just the repair, it is the days and weeks without a car.

Most M1 collisions we see are nose-to-tail in the morning peak, lane-change sideswipes near the Berowra on-ramp, and rear-end hits in the roadworks zones. Fault is usually clear, which makes the replacement car claim straightforward.

What to do on the shoulder near Berowra or Mount White

Get everyone out of the car and behind the barrier, not beside it. On the M1 the barrier is the only safe place. Call 000 if anyone is injured, then call the police assistance line on 131 444 if the road is blocked or a driver has left. For a crash with no injuries and both cars driveable, you still want a police event number, because insurers ask for it.

Then work through this in order:

  1. Photograph the scene before anything moves: both number plates, both cars from four angles, the road markings, the nearest green kilometre marker or exit sign. The M1 has distance markers and they settle arguments about where the crash happened.
  2. Photograph the other driver's licence, rego papers and insurer details. Check the licence address, because interstate drivers are common on this road.
  3. Note the time, the weather, the traffic and any witnesses. Ask a witness for their mobile number before they drive off.
  4. Do not discuss fault at the roadside. Give your details and take theirs. Admissions get repeated to insurers and can be used against you later.
  5. If your car is not driveable, agree with the tow operator where it goes before the truck hooks up.

If your car is driveable, get off the motorway at the first exit and stop somewhere safe, such as the Berowra or Mount Colah service centres, before you start the paperwork. Standing on the shoulder to fill in a form is how people get hit a second time.

Exchanging details with interstate or rental drivers

The M1 is a holiday and freight road, so a fair share of at-fault drivers are from Queensland, Victoria or further afield, or are driving a rental or a company vehicle. That changes the paperwork but not your rights.

If the at-fault driver is from interstate, their insurer is still on the hook for your loss of use under NSW law, because the crash happened here. Take the interstate address and licence number, and ask for the name of their insurer. If they cannot tell you, your own insurer or a credit hire provider can find it from the rego. Do not accept "I will sort it when I get home" as a plan.

If the at-fault driver was in a rental car, the rental company's insurer or the driver's own policy usually responds. Get the rental agreement if you can, or at least the rental company name and the vehicle's rego. The driver's personal insurer is often the one that pays.

If the at-fault driver was in a company ute or truck, the company is vicariously liable for its driver, which usually makes the claim easier, not harder. Fleet managers should read business and fleet before they call anyone.

Whichever it is, the same rule applies: you claim against the at-fault driver, and their insurer stands behind them.

Towing and storage options on the M1 corridor

Tow trucks on the M1 are dispatched by the traffic management contractor, and the first truck on scene may not be your choice. You have the right to nominate where the car goes, but you need to say so before the truck leaves.

Realistic options along the route:

  • Berowra and Mount Kuring-gai have small holding yards. They are fine for a night but not for a two week repair.
  • Hornsby and Waitara have larger yards and several prestige-capable repairers within a few kilometres.
  • Gosford, West Gosford and Tuggerah have the main Central Coast yards, and most Central Coast repairers will collect from them.
  • If you live on the North Shore and work in the city, it is often worth paying to move the car to a repairer near home rather than leaving it at Mount White for a week.

Storage fees add up daily and insurers push back on long storage. Decide on a repairer within 48 hours and have the car moved once. Ask the tow operator for the yard address, the storage rate and a receipt, and photograph the car again at the yard before you leave it.

If you are unsure who should repair it, our page on repairs and write-offs walks through the choice.

Replacement car delivery to the Central Coast or North Shore

This is the part that matters most, because a replacement car you have to collect from Sydney is not much use when you live in Terrigal and your car is at West Gosford. A like-for-like replacement should be delivered to you, whether that is a driveway in Erina, a workplace car park in Macquarie Park, or a repairer in Hornsby so you can hand back the loan car when your own is ready.

Delivery along the M1 corridor is routine. Typical drop-off points we see are Gosford, Erina, Terrigal, Woy Woy, Umina, Hornsby, Waitara, Pymble, Chatswood and North Sydney. If you are staying with family at Avoca while your car is repaired, that is fine too, as long as the address is agreed before the booking is confirmed.

Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group. The rate, the bond and every fee for the replacement car are shown on the car's page before payment, so there are no surprises when the driver hands you the keys.

If you drive something with real performance, the replacement should match it. A Macan GTS is a sensible stand-in for a daily performance SUV, and it is delivered, not collected.

How a not-at-fault replacement runs
AccidentClaim lodgedCar deliveredYour car repairedHire recovered from the at-fault insurer

Dealing with the at-fault insurer

The at-fault insurer will usually call you within a few days. They are entitled to ask questions, and you are entitled to answer them carefully. The trap is the offer of a small courtesy car from their preferred supplier, which is often a compact hatchback with a short time limit. Accepting it does not end your claim, but it does make the argument about like-for-like harder later.

What to do:

  • Give the facts: date, time, location, what happened, who was there. Do not speculate about fault or about your injuries.
  • Ask for the claim number and the name of the assessor in writing, by email.
  • Say that you will arrange a replacement car of similar type and quality and that you will provide the invoices.
  • Do not sign a release or a settlement until you understand what it covers. If in doubt, talk to your solicitor.

The legal basis is the High Court's decision in Arsalan v Rixon, which confirmed that a not-at-fault driver can recover the reasonable cost of a replacement car even if they did not actually hire one. Our plain-English explainer is at Arsalan v Rixon explained.

If the insurer disputes the rate or the duration, the argument is about reasonableness, not about whether you are entitled. Read the reasonable hire car test and insurer disputes.

What you never pay on a not-at-fault claim

On a not-at-fault claim in NSW, the at-fault driver's insurer is liable for your reasonable loss of use. That means you should not be paying the daily rate of the replacement car out of your own pocket while the claim is running, and you should not be paying the tow or the storage either.

What you do pay, on any hire:

  • The bond, which equals the excess you choose. It is refunded when the car comes back as it left.
  • A small surcharge if you pay by card. Bank transfer and cash on the rental do not carry it.
  • Traffic fines and tolls you incur while the car is with you.
  • Fuel and any damage you cause.

What you never pay on a properly run not-at-fault claim: the hire rate itself, the tow from the M1, storage at the holding yard, or an admin fee for arranging the replacement. If someone asks you for a fee to arrange a not-at-fault replacement car, walk away. More at what you never pay.

If your own insurer is pressuring you to use their repairer or their hire car, remember that you can claim against the at-fault driver directly. Your own insurer and a not-at-fault claim explains when that helps.

Timelines to expect after an M1 crash

Every claim is different, but the M1 pattern is consistent enough to plan around.

StageTypical timing
Tow and storageSame day, often within 90 minutes on the M1
Replacement car deliveredSame day or next business day, once fault and cover are confirmed
Assessor inspects2 to 5 business days
Repair authorised3 to 10 business days after inspection
Parts arrival for prestige models1 to 4 weeks, longer for European marques
Repair time1 to 3 weeks for panel work, longer for structural or airbag jobs

The single biggest delay is parts. A bumper for a European performance car can sit in a Sydney warehouse or take weeks from overseas, and the repairer cannot start until it lands. That is why the replacement car period often runs to three or four weeks, not three or four days.

Keep a simple log: date of crash, date the car went to the repairer, date the replacement arrived, date the repair finished. If the insurer argues about duration, that log is your evidence. See how long prestige repairs take in Sydney.

Getting the replacement car moving today

If you were hit on the M1 and you are not at fault, the fastest path is to confirm the basics, choose a repairer, and get a like-for-like car delivered to your address on the Central Coast or the North Shore. You do not need to wait for the at-fault insurer to approve anything before you arrange it, provided the replacement is reasonable for your car and the period.

Start with the first 24 hours if the crash was today, and like-for-like if you want to understand what a fair replacement looks like for your model. If you are a repairer, solicitor or broker referring clients, partners and referrals explains how that works.

Questions people ask

Can I get a replacement car on the Central Coast?
Yes. Replacement cars are delivered to Central Coast addresses including Gosford, Erina, Terrigal, Woy Woy and Umina, usually the same day or the next business day once fault and cover are confirmed. Delivery to a repairer in West Gosford or Tuggerah is common so you can hand the loan car back when your own is ready. The rate, the bond and every fee are shown on the car's page before payment.
What if the at-fault driver is from interstate?
It makes no difference to your claim. Because the crash happened in NSW, the at-fault driver's insurer is liable for your reasonable loss of use under NSW law. Take their interstate address, licence number and insurer name, and photograph their rego. If they cannot name their insurer, the rego is enough for your own insurer or a credit hire provider to trace it. Do not wait for them to sort it out when they get home.
How long does a repair take after an M1 crash?
For panel damage, expect one to three weeks once the repairer starts. The delay is usually parts, especially for European prestige models, which can take one to four weeks to arrive. Structural or airbag damage takes longer. Add two to five business days for the assessor and three to ten for authorisation. A realistic total from crash to keys back is often three to five weeks.
Do I have to use the at-fault insurer's repairer or hire car?
No. You can choose your own repairer and arrange your own replacement car, then claim the reasonable cost from the at-fault insurer. Accepting their courtesy car does not end your claim, but a compact hatchback rarely matches a prestige or performance car, and it can weaken the like-for-like argument. Keep the invoices and a simple log of dates.
What does like-for-like actually mean after an M1 crash?
Like-for-like means a replacement of similar type, quality and performance to the car you lost, for a reasonable period. If you drive a performance SUV, a comparable performance SUV is the fair replacement, not a small hatchback. The High Court in Arsalan v Rixon confirmed that a not-at-fault driver can recover the reasonable cost of a replacement car, and reasonableness is judged on your circumstances.
Who pays the tow and storage after an M1 crash?
On a not-at-fault claim, the at-fault driver's insurer is liable for the reasonable tow and storage costs. You should not be paying them out of your own pocket. Keep the tow receipt and the yard address, and move the car to your chosen repairer within 48 hours so storage does not run up. If you are asked for a fee to arrange any of this, walk away.
