Not at Fault Replacement Car in South West Sydney: Liverpool, Campbelltown and the Hume Corridor

If you were hit by another driver in South West Sydney and your car is off the road, you can keep driving something comparable while the at-fault insurer pays for the hire. That is the short version of not-at-fault replacement car hire, and it applies whether you live in Liverpool, work in Campbelltown or commute the Hume Highway every morning.

This guide covers what to do at the scene, where to tow and repair, how delivery works to your home or workplace, and how long you can realistically keep the replacement. It is written for people who drive something worth replacing properly, not a base model hatch.

Key takeaways

  • If another driver caused the crash, you can keep driving a comparable car while yours is repaired, and the at-fault insurer is generally responsible for the reasonable hire cost.
  • Delivery is available across South West Sydney, including Liverpool, Campbelltown, Ingleburn, Moorebank, Narellan and Camden, to your home, workplace or repairer.
  • Like-for-like means comparable in size, specification and standing, not the cheapest car on the lot, and Arsalan v Rixon supports that principle.
  • You keep the replacement for as long as the repair genuinely takes, so keep a dated log of estimates, parts updates and repair milestones.
  • Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group.

Crash hotspots: Hume Highway, M5 and Camden Valley Way

South West Sydney crashes cluster on a handful of roads, and knowing them helps you plan both the claim and the replacement car.

  • Hume Highway, Liverpool to Campbelltown: heavy commuter traffic, frequent rear-end and lane-change collisions, especially around the Casula and Glenfield interchanges. The 6am to 8am run towards the city and the 4pm to 6pm run home are the worst windows.
  • M5 South West Motorway: fast-moving, multi-lane and unforgiving. Rear-end collisions near the Moorebank Avenue and Camden Valley Way exits are common, and the M5 is also where minor collisions turn into multi-car pile-ups.
  • Camden Valley Way: a mix of 80 km/h stretches and signalised intersections. Left-turn and right-turn crashes at the Narellan Road and Bringelly Road junctions are regular.
  • Appin Road and the Picton corridor: rural-style speeds with urban traffic volumes, and long response times for tow trucks.

If you are hit on any of these, the at-fault driver is usually easy to identify and their insurer is usually easy to identify too. That is what makes the replacement car claim straightforward.

What goes wrong is the follow-up: people accept a hire car from the tow company, or from the at-fault insurer's preferred provider, and end up in a compact SUV when they normally drive a performance sedan. That is a like-for-like problem, and it is fixable if you act before you sign anything. Read our like-for-like guide before you agree to any replacement.

What to do at the scene in South West Sydney

Where you are matters. On the M5, you cannot safely stop on the shoulder for long, and on Camden Valley Way you may be blocking a live lane. Get safe first, then document.

  1. Move off the road if the car is drivable. Hazard lights on. If you cannot move, stay belted and call 000.
  2. Call police if anyone is injured, if the other driver leaves, or if the other driver appears affected by drugs or alcohol.
  3. Photograph everything: both cars from four angles, the road layout, lane markings, traffic signals, the other driver's licence and rego, and any witnesses.
  4. Get the other driver's name, address, phone, licence number, registration and insurer if they know it.
  5. Do not admit fault, and do not argue about fault. Fault is decided later, by insurers and sometimes by courts.
  6. Note the time, the weather and the traffic conditions. If a dashcam was running, preserve the file.

In Liverpool and Campbelltown, police attendance can take a while at peak hour. If the cars are drivable and nobody is hurt, you may be directed to exchange details and move on. Do that, but photograph the scene before you leave.

If your car is not drivable, you are now in a tow-truck conversation. That is where a lot of not-at-fault claims go sideways, so read the next section before you agree to anything. Our first 24 hours guide walks through the calls in order.

Towing and repairer options

South West Sydney has no shortage of tow operators, and the ones who arrive first are not always the ones you want. You are entitled to choose your own repairer, and you are entitled to have the car towed to that repairer, not to a holding yard chosen by someone else.

Practical rules:

  • Ask the tow operator for the total cost in writing before the car moves, and where it is going.
  • If the tow company wants you to sign a hire car authority, stop. That document often commits you to a hire car you did not choose.
  • If the car is drivable but unsafe, have it towed to a repairer you trust in Liverpool, Campbelltown, Ingleburn, Moorebank or wherever suits you.
  • Prestige and performance cars need a repairer with the right equipment and the right panel and paint capability. A general shop that mostly does family SUVs may not be the right home for a European performance car.

Your own insurer may push you towards a preferred repairer. You can decline. The at-fault insurer may also push you towards their network. You can decline that too. What matters is that the repair is done properly and that the hire car claim is not derailed by a repairer who will not talk to the hire company.

If you are unsure who to use, our prestige repairer versus insurer preferred repairer page sets out the trade-offs. For the repair timeline itself, see how long prestige car repairs take in Sydney.

Delivery to home, work or the repairer

You do not have to collect a replacement car from the city. Delivery is available across South West Sydney, including Liverpool, Campbelltown, Ingleburn, Moorebank, Narellan, Camden, Edmondson Park and the surrounding suburbs.

Typical delivery points:

  • Your home, if the car is off the road and you are working from home or on leave.
  • Your workplace, if you need to keep commuting. Liverpool CBD, Campbelltown CBD, the Moorebank and Prestons industrial estates and the Badgerys Creek construction corridor are all routine.
  • The repairer, if you want the handover to happen where the damaged car is being assessed.

Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group. You can see the accident replacement fleet and start a booking at accident replacement car Sydney.

What to have ready when the car arrives: your licence, the other driver's details, the police event number if you have one, and your claim reference if your own insurer is involved. The handover itself takes a few minutes. Photograph the car before you drive away, as you would with any hire car.

If you need something that can tow, carry a crew or handle a site, a dual-cab ute is often the right like-for-like answer.

Why like-for-like matters for local prestige owners

Like-for-like means the replacement should be broadly comparable to the car you lost the use of. It does not mean identical, and it does not mean the cheapest car on the lot. It means comparable in size, specification, transmission and general standing.

If you drive a European performance sedan and you are handed a base compact SUV, you have not been made whole. You have been inconvenienced twice: once by the crash, and again by the replacement.

This matters more in South West Sydney than people expect, for three reasons:

  • Commuting distances are long. Liverpool to the CBD, Campbelltown to Parramatta, Edmondson Park to the airport: these are not short trips, and the car you do them in matters.
  • Business use is common. Tradies, site managers, sales reps and small business owners in the region often use their car for work. A downgrade affects the business, not just the commute.
  • Family logistics are tight. Two or three kids, sport, school and after-school care. A smaller car does not fit the week.

The legal foundation for this sits in the decision in Arsalan v Rixon, which confirmed that a not-at-fault driver can recover the reasonable cost of a comparable replacement vehicle. Our not at fault explained page covers the principle, and like-for-like replacement car meaning in NSW goes into the detail.

If you drive something specific, our BMW M and AMG replacement cars page is a useful starting point.

Dealing with the at-fault insurer

Once fault is accepted, the at-fault insurer is on the hook for your reasonable replacement vehicle costs. In practice, they will try to control the process: they will offer their own hire car, at their own rate, for their own duration, and they will ask you to deal with their preferred provider.

You are not obliged to accept that offer. You can use a credit hire provider, which means the hire is arranged on your behalf and the cost is recovered from the at-fault insurer. You pay nothing upfront on an approved claim.

What the insurer will ask for:

  • Proof of the accident, usually a police event number or a report.
  • Photos and a description of the damage.
  • Confirmation of fault, or at least the other driver's details so they can confirm it.
  • A repair estimate and a repair timeline.
  • Regular updates on how long the repair is taking.

Where claims stall, it is usually because the repairer has not provided an estimate, or because parts are on backorder. Both are common with prestige cars. Our parts delays page explains what happens when a repair drags, and dealing with insurers covers the correspondence.

If the insurer disputes the hire, the dispute is between the hire provider and the insurer, not between you and the insurer. That is one of the practical advantages of credit hire. See how credit hire works and what is credit hire explained.

If you would rather read the background before you call anyone, not at fault in a car accident in NSW is a good primer.

How long you keep the replacement

You keep the replacement for as long as your car is genuinely off the road because of the repair, within reason. That is the principle. In practice, the timeline is set by the repair, and the repair is set by parts, labour and repairer capacity.

Typical patterns in South West Sydney:

SituationTypical hire duration
Panel and paint, parts in stockOne to two weeks
Structural repair, parts in stockTwo to four weeks
European prestige, parts on backorderFour to ten weeks
Repairable write-offUntil the write-off decision and settlement are finalised

Two things extend the hire legitimately. One is a parts delay that is outside your control. The other is a repairer backlog. Neither is your fault, and neither should shorten your entitlement.

Two things shorten it. One is accepting a cash settlement before the repair is done. The other is failing to chase the repairer for updates, which lets the insurer argue you were not mitigating your loss.

Keep a simple log: date of crash, date the car went to the repairer, date of each estimate, date of each parts update, date the repair finished. If the insurer queries the hire duration, that log answers most of it.

For the full picture, see how long can you keep a replacement car and repair delays: who pays for the hire car.

If the car is written off

Some South West Sydney crashes end in a write-off rather than a repair. If your car is declared a statutory write-off, it cannot be registered again in NSW, and the replacement car question changes from a repair timeline to a settlement timeline.

What happens next:

  1. The insurer assesses the car and issues a write-off decision.
  2. You negotiate or accept a settlement figure for the car's value.
  3. The replacement car hire continues while the settlement is being finalised, within reason.
  4. You then buy a replacement car, and the hire ends.

If you are not happy with the settlement figure, you can push back with comparable sales evidence. That is a negotiation, not a legal fight, at least at first. Our statutory write-off NSW page covers the process, and cash settlement versus repair covers the trade-off.

If the car is a repairable write-off, it can be repaired and re-registered, but the process involves inspection and paperwork. Our repairable write-off NSW guide sets it out.

Business owners in the region should also read fleet vehicle repair and write-off delays, because a written-off work ute or van has a direct cost beyond the vehicle itself.

Returning the car

Return is the part most people forget to plan. The replacement car goes back when your car is repaired and back in your hands, or when the write-off settlement is finalised and you have bought a replacement.

Before you hand the keys back:

  • Refuel or recharge to the level it was delivered at, unless your agreement says otherwise.
  • Remove personal items, toll tags, phone mounts and anything in the boot.
  • Photograph the car and the odometer.
  • Check for any damage that happened during the hire and report it.
  • Get a return receipt or confirmation email.

Return can usually be arranged at the same place the car was delivered, or at a Drive Tribe location. If you collected in Liverpool and your car is repaired in Campbelltown, that is a conversation worth having early rather than on the last day.

If you are booking, the rate, the bond and any fees are shown on the car's page before payment. Paying by card carries a small surcharge, while bank transfer and cash on the rental do not. The bond equals the excess you choose. The minimum driver age is 20 on most cars, and 25 or 30 on some. Cars can be booked from a single day.

To start, see not at fault accident replacement, browse accident replacement vehicles, or go straight to Drive Tribe.

Business fleets and referral partners in the region

South West Sydney runs on small business, and a lot of those businesses run vehicles. A crash that takes a ute, van or dual-cab off the road for three weeks is a revenue problem, not just a transport problem.

For fleet managers, the priorities are different from a private claim:

  • Keep the vehicle count stable so crews and deliveries keep moving.
  • Keep the replacement comparable, so the driver can do the same work.
  • Keep the paperwork clean, because the at-fault insurer will scrutinise a business hire more closely than a private one.
  • Keep the hire period tied to the repair, not to a fixed number of days.

Our business and fleet page covers the process. If you are a smash repairer, solicitor or broker in Liverpool, Campbelltown, Ingleburn or Narellan and you refer clients regularly, partners and referrals explains how that works.

If you are still working out whether you have a claim at all, start with what not at fault means in NSW and what to do after a car accident not at fault. If you are disputing a decision, insurer disputes and hire car claims is the next stop.

And if you just want to know what is available in your area, replacement by area and replacement by car type will get you there faster than a phone call.

Questions people ask

Can I get a replacement car delivered to Liverpool?
Yes. Delivery is available across South West Sydney, including Liverpool, Moorebank, Prestons, Casula, Edmondson Park and the surrounding suburbs. You can take delivery at home, at work, or at the repairer where your car is being assessed. Have your licence, the other driver's details and any claim reference ready for the handover. The rate, the bond and any fees are shown on the car's page before payment, and cars can be booked from a single day.
What if my car is repaired in Campbelltown?
That is fine. You choose the repairer, not the insurer and not the tow company. Delivery and collection can be arranged around Campbelltown, Ingleburn, Narellan or Camden, and the replacement stays with you for as long as the repair genuinely takes. Keep a dated log of the estimate, the parts updates and the completion date, because that log is what supports the hire period if the at-fault insurer asks questions later.
Do I need to pay a bond?
A bond applies, and it equals the excess you choose. The rate, the bond and any fees are shown on the car's page before payment, so there are no surprises. Paying by card carries a small surcharge, while bank transfer and cash on the rental do not. On an approved not-at-fault claim, the hire cost itself is recovered from the at-fault insurer, so you are not paying the daily rate upfront.
How long can I keep the replacement car?
You keep it for as long as your car is genuinely off the road because of the repair, within reason. Panel and paint with parts in stock might be one to two weeks. Structural repairs two to four weeks. European prestige cars with parts on backorder can run four to ten weeks. If the car is written off, the hire generally continues until the settlement is finalised and you have bought a replacement.
What if the at-fault insurer refuses to pay for the hire car?
That dispute is usually between the hire provider and the insurer, not between you and the insurer. With credit hire, the provider arranges the car and recovers the cost from the at-fault insurer. You still need to cooperate: provide photos, the police event number, the other driver's details and repair updates. If the insurer disputes the rate or the duration, the provider handles that correspondence on your behalf.
Can I use my own repairer in South West Sydney?
Yes. You are entitled to choose your own repairer, and you can decline the insurer's preferred network. For prestige and performance cars, choose a shop with the right equipment and panel and paint capability, and one that will communicate with the hire provider about timelines. A repairer who will not send updates is the most common reason a hire car claim gets challenged. General information only; for advice on your circumstances, talk to your solicitor.
