Accident replacement car in the Sutherland Shire

If another driver caused the crash, you are entitled to a replacement car that matches the one you normally drive, and the at-fault insurer pays for it. That means a prestige SUV or performance car delivered to your driveway in Cronulla, Miranda or Engadine, usually within a day or two of your claim being accepted.
This page explains how it works in the Shire, from the Princes Highway at Kirrawee to the Tom Uglys Bridge at Sylvania, what to collect at the scene, how to prove fault, and what happens when the other driver is uninsured or your car is written off.
Key takeaways

What to do after a crash in the Shire
Shire crashes tend to happen in predictable places. The Princes Highway between Sutherland and Engadine, the Taren Point Road merge near Caringbah, the Tom Uglys Bridge approach at Sylvania, and the Kingsway at Cronulla on a Friday afternoon. If you have been hit on any of them, the first ten minutes matter more than the next ten days.
Pull off the road if you can. Put your hazards on. Check that everyone is okay and call triple zero if anyone is hurt. Then start collecting what you will need later:
- Photos of both cars from several angles, including number plates.
- A photo of the other driver's licence and their insurer, if they will show you.
- The other driver's name, phone number and address.
- Witness names and numbers. Sutherland Shire locals tend to stop, so ask.
- Dashcam footage, downloaded before it overwrites.
Do not argue about fault at the scene. Do not accept cash. Do not sign anything from the other driver's insurer without advice. If the police attend, ask for the event number.
Once you are home, call your own insurer to report the incident even if you are not claiming, and start the replacement car process in parallel. The full checklist is in our guide to the first 24 hours after a not-at-fault crash.
Proving the other driver was at fault
Everything downstream depends on fault. If the other driver ran a red at the President Avenue intersection, rear-ended you on the Princes Highway at Gymea, or turned across you on the Kingsway, you have a strong position. If it is word against word, you have work to do.
The evidence that carries weight:
- A police event number, if police attended.
- Dashcam or CCTV footage. Service stations, car parks and shopfronts along the highway often have cameras.
- Witness statements, written and signed the same day.
- Photos showing impact points, skid marks, traffic lights and lane positions.
- Your own written account, made within hours while it is fresh.
Under NSW law, the at-fault driver is liable for your loss of use, which is the legal term for the cost of a replacement car while yours is off the road. The High Court confirmed that position in Arsalan v Rixon. You do not need the other insurer to admit fault before you get moving, but you do need a reasonable case. Our page on proving the other driver was at fault goes deeper, and what not at fault means in NSW covers the grey areas.

Age limits are set per car. Drivers under 25 can hire most cars with Young Driver Cover; the exact terms are shown before you pay.
Your entitlement to a like-for-like replacement car
Like-for-like does not mean a small hatchback that gets you to work. It means a car of similar make, model, age, condition and prestige to the one you were driving. If your daily is a BMW X7, you are entitled to something in that class, not a base Corolla.
That is where a prestige replacement fleet matters. Drive Tribe, trading as drivetribe.com.au, is the fulfilment company behind this site and supplies the vehicles. Cars are collected from Mascot or delivered across Sydney, including the Shire, and every booking is made online with the rate, bond and any fees shown on the car's page before payment.
Typical like-for-like matches for Shire drivers:
- Seven-seat family SUV, replaced with a BMW X7, Mercedes-Benz GLS or Audi Q7 Quattro.
- Large non-prestige SUV, replaced with a Toyota Kluger GX.
- Performance sedan or coupe, matched through our BMW M and AMG replacement cars page.

Not at fault? Start your claim
A like-for-like replacement car while yours is repaired. No cost to you when the other driver is at fault.
Start my claimDelivery across the Shire: Cronulla, Miranda, Engadine and beyond
Most Shire drivers do not want to catch a train to Mascot to pick up a car. Delivery is available, and it is usually the same day or next day once your claim is approved.
Where we deliver:
- Cronulla, Woolooware and Caringbah, including the apartment blocks near the beach.
- Miranda, Gymea and Sylvania, close to the Westfield and the Tom Uglys approach.
- Engadine, Heathcote and the highway corridor south.
- Menai, Bangor and Alfords Point in the west of the Shire.
Delivery is to your home, your workplace or the smash repairer holding your car. If your car is at a panel shop in Kirrawee or Taren Point, we can meet you there so you hand over the keys and drive away in the replacement in one trip.
What to have ready: your licence, the claim details, and somewhere legal to park the replacement. Most Shire streets are fine during the day; Cronulla on a summer weekend is not. If parking is tight, tell us and we will arrange a nearby meeting point.
If you are outside the Shire, our replacement by area page covers the rest of Sydney.

How the at-fault insurer's obligations work
The other driver's insurer owes you a duty to put you back in the position you were in before the crash. That includes your loss of use. In practice, they will often try to steer you to their own preferred hire supplier, or offer a smaller car than the one you drive. You are not obliged to accept either.
What usually happens:
- You lodge your claim and provide evidence of fault.
- The insurer assesses liability, which can take days or weeks.
- A credit hire company provides the replacement car in the meantime and recovers the cost from the insurer later.
- If the insurer disputes the rate or the duration, the matter is negotiated between the hire company and the insurer, not you.
Credit hire means you do not pay upfront. The hire company carries the risk of recovery. Our how credit hire works and credit hire versus paying yourself pages explain the difference. If the insurer is slow, see insurer delays and the at-fault insurer's obligations in NSW.

What happens if your car is written off
A write-off changes the maths but not your entitlement. If your car is declared a statutory or economic write-off, the insurer owes you its market value, and you are still entitled to a replacement car for a reasonable period while you find a new one.
In the Shire, write-offs often happen on the highway at high speed, or in multi-car prangs at the Taren Point Road intersection. If your car is towed to a holding yard, get the location and the tow company name before you leave the scene.
What to do:
- Confirm in writing whether it is a repairable write-off or statutory write-off.
- Get the insurer's valuation in writing and compare it with comparable listings.
- Keep the replacement car until you have settled and bought a new vehicle, within reason.
- Do not accept the first offer if it is well below market.
Our repairs and write-offs page covers the process, and written off not at fault explains how the replacement car works in that scenario.

The cost to you: zero
If you are not at fault, the replacement car should cost you nothing. The at-fault insurer pays the hire cost as part of your loss of use. You do not pay a daily rate, a bond in the usual sense, or an excess for the hire.
What you may see:
- A small surcharge if you pay by card. Bank transfer and cash on the rental do not carry it.
- The bond equals the excess you choose, and it is held, not spent.
- Fuel, tolls and any fines are yours, as they would be in your own car.
Everything else, including the rate, the bond and any fees, is shown on the car's page before you pay. No surprises at the counter.
If the other driver is uninsured, your options change. You may need to claim through your own insurer or pursue the driver directly. Our claiming your own insurer page explains when that makes sense. For a general overview, see accident replacement vehicles.
Business fleets and Shire trades
If you run a business in the Shire, a car off the road is a revenue problem. Ute off the road means a job not done. A director's car off the road means meetings missed. Fleet managers in Kirrawee, Taren Point and Miranda should treat a not-at-fault crash as a claim, not a cost.
What we can arrange:
- Like-for-like replacements for fleet vehicles, including SUVs and people movers.
- Delivery to your yard or the driver's home.
- Consolidated invoicing and a single point of contact for multiple vehicles.
Our business and fleet page covers the process, and partners and referrals is for smash repairers, solicitors and brokers who want a reliable referral partner in the Shire.
